Patent and Copyright Lawyers | ArticlesBase.com

July 28th, 2009

Choosing a patent or copyright lawyer can be difficult, especially if you are already having legal troubles that are causing lots of stress. If you follow these guidelines, though, you should be able to disregard the lawyers in your area that cannot give you the services and advice that you need so you can focus on those that are right for you.

Patent and Copyright Lawyers

You will probably have to talk to several patent and copyright lawyers before you find the one that you want to hire. Making the right decision is very important, so you want to take your research seriously. Taking it lightly could be a costly mistake.

First, you might want to ask the lawyers what types of law they practice. If you have never used the services of a lawyer or law firm before, them you might not know that attorneys focus on specific parts of the law. Some of them might be experts in tax law, family law, or drug law, but that does not mean that they can give you the patent and copyright services that you need.

Patent and Copyright Lawyers with Experience

When you contact the lawyers and firms in your area, you should ask them what types of law they practice. You might find that many of them cannot give you the services that you need. Others, however, should have an abundance of experience with copyright or patent law. Ask them how long they have offered their legal services to clients to help you get a better idea of how much experience they have. Those with the most experience should presumably know the law very well.

Patent and Copyright Lawyers with Professional Educations

The level of experience that someone has may tell you a lot about how well they can perform their job, but you should also find out what level of training the person has had. Since lawyers are required to attend law schools and pass the Bar Exam for the states that they practice in, you know that they have some basic skills. Not all law schools are equal, though, so you should ask them where they got their educations. If it is a respected school, then you might assume that the lawyers who graduate from there receive good educations. You should also ask the lawyers if they are currently in good standing with the Bar Association. You can always contact the Bar Association to confirm this information.

Patent and Copyright Lawyers with References

Knowing that a lawyer has a good education and is in good standing with the Bar Association tells you a lot, but you still cannot be sure that she or he can give you the copyright or patent legal services that you need. That is why it makes sense to ask them for references. Their other clients will know better than anyone if the lawyer is reliable, knowledgeable, and hard working. Talking to the lawyer’s other clients can be one of the best ways to find out if she or he is worth hiring.

Violation of Copyright Law 1957 | ArticlesBase.com

July 26th, 2009

The Indian Copyright Law under the Indian Copyright of 1957 is the true manifestation of the Berne Convention of Copyrights, of which India is an active member. Moreover, India is also a dynamic member of World Intellectual Property Organization, Geneva. The act was put in place in 1957 by the government of India to protect the interest of pioneers and dreamers.

The Indian Copyright Law of 1957 bans the reproduction of a previously written artistic material or performance rights without prior consent of the owner. The law clearly states that the owner has the sole right on his copyright. The law not only protects works of art from ‘theft’ but also protects dramatic, artistic and musical works along with cinematography films and sound recording.

The use of ‘available material’ without sanction of author for personal profit is illegal and this act breaks the copyright law 1957. There are special copyright attorneys in India that can help you in the case of any possible violation. Violation of copyright law 1957 is an offense and is punished likewise. However there are some cases where the law cannot be enforced. If the theme is the same, but it is presented as a new work with no reference to the original one, there is no violation of the law.

You will get the best results if you take help, in case of any violation, of trained copyright lawyers. Moreover there are a number of agencies in India offering copyright services, and can help you in case of any breach of intellectual property. Many pioneers create a copyright management system in which they protect their online data using passwords and registration. However be careful that you hire a reputed Indian attorney for your work.
